On Friday, July 28, 2023, Johnson & Johnson lost another battle in its defense of claims that its talcum powder causes cancer. A bankruptcy judge in New Jersey denied J & J’s second attempt to file for bankruptcy. Michael B. Kaplan of the U.S. District Court for the District of New Jersey announced his decision following a hearing for J & J’s filing of Chapter 11 during which several experts testified. Judge Kaplan ruled “the evidentiary record fixed at trial does not establish sufficient ‘imminent’ or ‘immediate’ financial distress to satisfy the criteria enunciated by the 3rd Circuit.”
The issue of asbestos contamination in talc-based products, including talcum powder, has led to various lawsuits against companies like Johnson & Johnson.
J & J has faced multiple lawsuits related to allegations that its talc-based products, such as baby powder, contributed to the development of cancer, particularly ovarian cancer and mesothelioma. These lawsuits claimed that the talc used in the products was contaminated with asbestos, which is a known carcinogen.
Some of the lawsuits filed against J & J allege the manufacturer had knowledge of the potential asbestos contamination in its talc products for many years but failed to warn consumers adequately about the possible risks. Plaintiffs argued that the company continued to market these products to mothers and children without disclosing the potential danger.
J & J has consistently defended the safety of its talc-based products and denied any link between talc use and cancer. They maintain that its products were thoroughly tested and free from asbestos, and any claims to the contrary were based on flawed studies and misinterpretation of data.
