Product Liability

Defective Product Litigation and Product Liability – Retain a Skilled Lawyer from Our Pennsylvania or New Jersey Offices

When you buy or use a product for its intended purpose, there is an implicit guarantee that the product is free of defects that could possibly injure or kill you. However, people are regularly hurt by defective products. Products can be deemed defective as the result of a design defect, a manufacturing defect, negligent marketing, a failure to warn, or a failure to make reasonable protective equipment to guard against injuries.

If you have been injured or a loved on has been killed by a defective product, a product liability lawyer (also known as a defective product lawyer) at Shein Law Center in Philadelphia, Pennsylvania or Pennsauken, New Jersey can help you pursue justice against the manufacturer. With an experienced team of attorneys, Shein Law Center is well-equipped to handle your case. Contact us today.

Types of Product Liability Cases We Handle

Defective Medical Devices and Products

Sadly, many patients are hurt, rather than helped, by medical devices and products that turn out to be defective. Some of these defective medical devices and products include contaminated allograft implants, defective cardiac devices, joint replacement implants, and Bausch & Lomb ReNu with MoistureLoc® contact lens solution. If you have been injured by these medical products or devices similar to these, contact a defective product lawyer at our offices in Philadelphia, Pennsylvania or Pennsauken, New Jersey to discuss your case.

Chemical Exposure

Defective products sometimes expose consumers to toxic chemicals. When a consumer uses a product properly, and for its intended use, and is subjected to chemical exposure as a result, the manufacturer may be held liable.

The best example of this type of case is asbestos exposure, which can lead to mesothelioma, asbestosis, lung cancer, and other types of cancer. In the case of asbestos, consumers were not properly warned that exposure to asbestos could be dangerous, nor were employees properly protected from asbestos at worksites despite employer’s knowledge of the harmful effects of the product.  If you are exposed to dangerous chemicals or toxic substances as a result of a defective product, contact a product liability lawyer at Shein Law Center today.

Dangerous Pharmaceuticals

Too often, pharmaceutical companies put drugs on the market that can injure or even kill patients. Sometimes the risks posed by these defective drugs are not known when the drug goes on the market. And in other cases, the drug’s maker puts profits above all else and hides evidence of the drug’s harmful effects from the FDA.

Classes of dangerous drugs include hormone, diet, and pain drugs, as well as pharmaceutical treatments for arthritis, high cholesterol, erectile dysfunction, and more

Tires

The tread separation risk of some tires has recently been in the news. While Firestone has drawn the majority of the controversy, plenty of other tire manufacturers, including Cooper, have recalled their defective tires for causing drivers undue danger. Cooper tires have caused at least 35 deaths over the past six years, and in 2000 when the infamous Firestone tire recall occurred, at least 271 Americans had died as a result of the tires. In the case of Firestone, 30 class-action suits were filed, and a judge approved a $149 million settlement.

If you have been injured as a result of a motor vehicle accident caused by tire separation or blowout, the tires may have been defective. Contact a product liability lawyer at Shein Law Center in Philadelphia, Pennsylvania and New Jersey to discuss the facts of your defective tire case today.

Household Appliances and Machinery

When a household appliance is proven to be faulty, the designer, manufacturer, or distributor may be liable. A consumer can be injured when they are sold a faulty product or are failed to be warned of the product’s risks. In these types of product liability cases, the consumer can be compensated for their injuries, as well as property damage. Defective product cases involving household appliances have stemmed from defective heaters, toasters, and other appliances. Other household defective items, ranging from tampons to food and drinks, can cause injury and even death to consumers.

If you have been injured as a result of a defective household item, contact a defective product lawyer at Shein Law Center today. With offices in Philadelphia and New Jersey, we are conveniently located to serve you.

Industrial Machinery

Defective industrial machinery such as forklifts, printing presses, rollers, hand tools, and industrial knitting machines can cause gruesome injuries and render some employees unable to ever work again. In some cases, injuries are caused by design or manufacturing defects; in others, accidents stem from a failure to warn or a failure to use protective equipment.

If you have been injured by a piece of defective industrial machinery while on the job, you may be able to recover lost wages, the cost of medical treatment, and perhaps more. Contact a product liability lawyer at Shein Law Center today.

Latex Products

A significant percentage of the population suffers allergies to latex; in severe cases, exposure to latex can cause people to go into anaphylactic shock. The manufactures of latex gloves and other latex products have been held liable for not properly warning nurses and other people who have come into contact with latex products and suffered reactions. If you have suffered a severe allergy after coming in contact with a latex product, you may have a product liability case, especially if you were not warned the product contained latex.

Lead Paint

Before it was banned from residential use in 1978, lead paint was commonly used to paint residences. Children were put at risk for lead poisoning by eating as little as a one-inch chip of paint, or ingesting lead paint dust through regular hand-to-mouth contact. Lead is especially dangerous to children under six. It can cause nervous system damage, hearing loss, reduced IQ, stunted growth, and delayed development.

In Rhode Island, the manufacturers of lead paint have been successfully held liable for the cost of detecting and removing lead paint and providing medical care to people poisoned by lead.

If you or your child has been injured by lead paint, it may be possible to hold the manufacturer or building owner liable. Contact a defective product lawyer at Shein Law Center today. Located in Philadelphia, Pennsylvania and Pennsauken, New Jersey, we can give you superior representation.

Surgical Tools

Just like other medical devices, surgical tools can have a defect that makes them unsafe for patients. Defective surgical tools can harm patients, as well as necessitate further surgery to fix the problem. If you have been harmed by a defective surgical tool, the manufacturer or doctor may be held liable.

Tobacco

Successful product liability lawsuits against tobacco companies have been based on the premise that smokers, just like any other consumer, have a right to purchase safe tobacco products. Tobacco companies have been accused of putting chemical additives in their cigarettes that make them unduly dangerous when used properly. In addition, some tobacco companies have been accused of misleading marketing that, for example, suggests that “light” cigarettes are less likely to cause lung cancer.

If you have developed a tobacco related illness and feel that it was a result of deceptive marketing or another form of negligence, you may be able to pursue a product liability case. Contact a defective product lawyer at our offices in Philadelphia, Pennsylvania or Pennsauken, New Jersey today.
